Terms of Service

1. Acceptance of Terms

By accessing or using the Service, you represent that: (a) you are at least 18 years of age; (b) you are the parent or legal guardian of the child(ren) who will use the Service; (c) you have read, understood, and agree to be bound by these Terms; and (d) you agree to our Privacy Policy, which is incorporated herein by reference.

If you are using the Service on behalf of a church, school, or organization, you also represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Rain Hope Games provides a faith-based Christian gaming platform that includes:

• Bible-based interactive video games for children ages 5–10
• Digital magazines featuring Bible stories, devotionals, and activities
• Interactive biblical avatar experiences (including optional voice interaction)
• Parental account management tools and child profile creation
• A curated marketplace featuring vetted third-party content (vendors and magazines that have passed our review process)

The Service is available on iOS, Android, and via web browser on PC/Mac. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Account Registration and Parental Responsibility

3.1 Parent/Guardian Accounts Only

Accounts may only be created by adults aged 18 or older who are the parent or legal guardian of the child(ren) using the Service. Children may not create their own accounts. This requirement is in place to comply with the Children's Online Privacy Protection Act (COPPA) and to ensure parental oversight of children's online activities.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at info@rainhopeworld.com of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to safeguard your credentials.

3.3 Accurate Information

You agree to provide accurate, current, and complete information when creating your account and to update that information as necessary. We reserve the right to suspend or terminate accounts that contain false or misleading information.

3.4 Child Profiles

After creating a parent account, you may create child profiles. You are solely responsible for supervising your child's use of the Service and ensuring that it is appropriate for their age and maturity level. Children may create custom avatars and select usernames; we encourage parents to assist in choosing usernames that do not reveal the child's real name.

4. Subscription Plans and Billing

4.1 Free Trial

New accounts receive a 3-day free trial with full access to the Service. A valid payment method is required to start the trial. If you do not cancel before the trial period ends, you will automatically be charged for the selected subscription plan.

4.2 Subscription Plans

All prices are in US Dollars. Prices are subject to change with 30 days' advance notice to subscribers.

4.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. By subscribing, you authorize us to charge your payment method on a recurring basis.

4.4 Cancellation

You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period — you will retain access to the Service until that date. Cancellation during the free trial period results in no charge.

4.5 Refunds

We do not offer refunds for partial billing periods. If you believe you were charged in error, contact us at info@rainhopeworld.com within 14 days of the charge and we will review your case. Refunds are issued at our sole discretion.

4.6 App Store Purchases

If you subscribe through the Apple App Store or Google Play Store, your subscription is governed by that platform's billing terms. Cancellations and refunds for app store purchases must be managed through the respective app store, not through Rain Hope Games directly.

5. Acceptable Use Policy

You agree to use the Service only for its intended purpose — providing a safe, faith-based gaming experience for children. You agree not to:

• Allow any person under 18 to create a parent account or manage billing
• Share your account credentials with individuals outside your immediate family
• Attempt to reverse engineer, decompile, or extract source code from the Service
• Use the Service for any commercial purpose without our prior written consent
• Upload, transmit, or distribute any content that is harmful, offensive, or violates any law
• Attempt to circumvent any security measures or access controls
• Use automated tools, bots, or scrapers to access the Service
• Interfere with or disrupt the integrity or performance of the Service
• Impersonate any person or entity or misrepresent your affiliation with any person or entity

Violation of this Acceptable Use Policy may result in immediate termination of your account without refund.

6. Audio and Microphone Use

Some games feature interactive biblical avatars that children can communicate with using their voice. Use of this feature requires microphone access and explicit parental consent, which is obtained during account setup.

By enabling voice interaction, you acknowledge and agree that: (a) audio is processed in real-time only and is never recorded, stored, or retained; (b) no audio data is shared with third parties; (c) you may revoke microphone permission at any time through your device settings; and (d) disabling microphone access will only affect the voice interaction feature — all other game features remain fully accessible.

This feature complies with COPPA requirements regarding audio data collection from children, as well as Google Play and Apple App Store microphone permission guidelines.

7. Marketplace and Third-Party Content

Our platform includes a curated marketplace featuring content from vetted third-party vendors and digital magazines. All marketplace participants undergo a rigorous review process to ensure their content is safe, biblically appropriate, and compliant with our privacy standards before being listed.

We do not share user data with marketplace vendors. However, if you choose to interact with or purchase content from a third-party vendor, that vendor's own terms and privacy policies may apply to that specific transaction. We encourage you to review third-party terms before engaging with their content.

Rain Hope Games is not responsible for the content, accuracy, or practices of third-party vendors beyond our vetting process. If you encounter content in the marketplace that you believe is inappropriate, please report it to info@rainhopeworld.com.

8. Intellectual Property

8.1 Our Content

All content on the Service — including games, characters, artwork, music, text, logos, and digital magazines — is owned by Rain Hope Games or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without our prior written permission.

8.2 User-Generated Content

Children may create avatars and select usernames within the Service. By creating such content, you grant us a non-exclusive, royalty-free license to use, display, and store that content solely for the purpose of providing the Service. We do not claim ownership of user-generated content.

8.3 Feedback

If you submit feedback, suggestions, or ideas about the Service, you grant us the right to use that feedback without any obligation to compensate you.

9. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Key commitments include:

• No advertising to children
• No sale or sharing of personal data with third-party marketers
• Parental consent required before any data collection from children
• Voice data processed in real-time only — never stored or shared
• Parents may review, correct, or delete their child's data at any time

10. Disclaimers and Limitation of Liability

10.1 Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

10.2 Limitation of Liability

To the fullest extent permitted by applicable law, Rain Hope Games shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising out of or in connection with your use of the Service. Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10.3 Indemnification

You agree to indemnify and hold harmless Rain Hope Games, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violation of these Terms, fraudulent activity, or any conduct we determine to be harmful to the Service or other users. You may terminate your account at any time by canceling your subscription and contacting us to request account deletion.

Upon termination, your right to access the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If a dispute cannot be resolved informally, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property violations.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action or representative proceeding.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email at least 30 days before the changes take effect. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes.
